These Terms of Service ("Terms") constitute a legal agreement between you and Food Companion developed by RAMBOLO LIMITED ("we," "us," or "our") governing your use of the FoodSaver mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

FoodSaver is a mobile application designed to help users discover discounted food from local bakeries, grocery stores, and restaurants. The App provides:

  • A listing of participating stores offering discounted food
  • An interactive map showing store locations
  • Shopping tips and food storage advice
  • Reminder features for store visits and expiration dates
  • A favorites list for quick access to preferred stores

The App serves as an informational platform and does not directly sell food products or facilitate transactions between users and stores.

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18 years of age, you should review these Terms with a parent or guardian to ensure they understand and agree to them.

4. User Responsibilities

When using the App, you agree to:

  • Provide accurate information when required
  • Use the App only for lawful purposes
  • Not attempt to interfere with or disrupt the App's functionality
  • Not use the App to transmit harmful code or malware
  • Not copy, modify, or distribute the App without authorization
  • Not use automated systems to access the App without permission
  • Comply with all applicable laws and regulations

5. Intellectual Property

The App, including its content, features, design, and functionality, is owned by Food Companion developed by RAMBOLO LIMITED and is protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, reproduce, or distribute any part of the App
  • Modify, adapt, or create derivative works based on the App
  • Use our trademarks, logos, or branding without written permission
  • Remove any copyright or proprietary notices from the App

6. Third-Party Content and Services

The App may display information about third-party stores, products, and services. We do not endorse, guarantee, or assume responsibility for:

  • The accuracy of store listings or availability of discounts
  • The quality, safety, or legality of products offered by stores
  • Any transactions between you and third-party stores
  • The content or practices of third-party websites linked from the App

Your interactions with stores and purchase of food products are solely between you and the respective stores. We encourage you to verify all information directly with stores before making purchases.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • ACCURACY, RELIABILITY, OR COMPLETENESS OF INFORMATION
  • UNINTERRUPTED OR ERROR-FREE OPERATION
  • SECURITY FROM UNAUTHORIZED ACCESS

We do not warrant that the App will meet your requirements or that any errors will be corrected.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Food Companion developed by RAMBOLO LIMITED SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, data, use, or goodwill
  • Any damages resulting from your use of or inability to use the App
  • Any damages resulting from unauthorized access to your data
  • Any matters beyond our reasonable control

Our total liability for any claim arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is less.

9. Indemnification

You agree to indemnify, defend, and hold harmless Food Companion developed by RAMBOLO LIMITED, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable law or regulation

10. Modifications to the App and Terms

We reserve the right to:

  • Modify, suspend, or discontinue the App at any time without notice
  • Update these Terms at any time by posting the revised version
  • Add or remove features and functionality

Your continued use of the App after any changes to these Terms constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the App will immediately cease
  • You must delete or destroy any copies of the App in your possession
  • Provisions that by their nature should survive termination will remain in effect

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Food Companion developed by RAMBOLO LIMITED is established, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through:

  • Good faith negotiations between the parties
  • Binding arbitration if negotiations fail
  • Courts of competent jurisdiction as a last resort

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Food Companion developed by RAMBOLO LIMITED regarding your use of the App and supersede all prior agreements and understandings.
